Terms of Service
These terms govern your use of roofnow.ca and your online interactions with RoofNow Inc., operating as ROOFNOW™. They explain the difference between website information, an estimate request and a binding written roofing contract.
Roofing suitability and project requirements must be assessed for the property.
A project begins only under an accepted written estimate or signed agreement.
Your contract and warranty documents govern the actual roofing work.
1. Acceptance of these terms
These Terms of Service (“Terms”) are an agreement between you and RoofNow Inc., operating as ROOFNOW™ (“ROOFNOW,” “we,” “us” or “our”), concerning your access to and use of roofnow.ca and its pages, information, forms and related online features (the “Website”).
By using the Website, you agree to these Terms. If you do not agree, do not use the Website. You must have legal capacity to agree to these Terms or use the Website with the involvement of a parent, guardian or authorized representative.
2. Website information is general
Website content is provided for general information and education about metal roofing, roofing profiles, installation considerations, maintenance, warranties and related services. It is not engineering, architectural, legal, financial or building-code advice for a specific property.
Every roof is different. Product suitability, installation method, ventilation, flashing, structural requirements, permits, snow management and other details must be evaluated for the actual building, site and applicable requirements.
3. Contact and estimate requests
Forms, emails, calls and messages let you request information or ask ROOFNOW to review a potential project. A submission:
- is not an acceptance of work by ROOFNOW;
- does not reserve installation dates, materials or pricing;
- does not guarantee product or service availability;
- does not create a contractor-customer or warranty relationship; and
- does not become binding until required written project documents are accepted.
Preliminary descriptions may change after measurements, inspection, product selection, access review and confirmation of the complete scope.
4. Written estimates and roofing contracts
Actual roofing work is governed by the written estimate, contract, change orders, specifications, payment terms, warranty documents and other project records accepted by the customer and ROOFNOW.
If these Website Terms conflict with an accepted written roofing contract, the written contract controls for that project to the extent of the conflict, subject to rights and obligations that cannot lawfully be excluded.
Changes to scope, product, colour, installation method, schedule or other material terms should be documented and accepted as required by the project agreement and law.
5. Information and customer responsibilities
When requesting or receiving service, you agree to:
- provide accurate contact, property and project information;
- have authority to request information or work for the property;
- disclose known leaks, hazards, structural concerns and access restrictions;
- review estimates, contracts, specifications and warranty documents;
- provide reasonable property access when agreed; and
- meet responsibilities stated in the written project agreement.
Incomplete or inaccurate information can affect scope, schedule, recommendations or an estimate.
6. Products, specifications, colours and images
Roofing profiles, colours, finishes, dimensions, accessories, certifications, manufacturer claims and availability may change. Product names and images may be supplied by manufacturers or authorized sources.
Screens display colours differently, and photographs can be affected by lighting, weather and camera settings. Website images and digital swatches are illustrative. Confirm current specifications and review physical samples where practical.
A product shown on the Website is not guaranteed to be suitable or available for every roof, location, timeline or project.
7. Product and workmanship warranties
Website statements about service life, durability, transferability or warranty coverage are general summaries and do not create or expand a warranty. Manufacturer warranties are governed by current written terms, conditions, exclusions, registration requirements and claim procedures.
ROOFNOW workmanship coverage, if provided, is governed only by the written terms issued for the specific project. Review all warranty documents before accepting a roofing agreement.
8. Acceptable use
You may use the Website only for lawful purposes. You must not:
- interfere with the Website, forms, servers, security or other users;
- introduce malware, harmful code, automated spam or fraudulent submissions;
- attempt unauthorized access, scraping, probing or security circumvention;
- misrepresent your identity, authority, property or project;
- exploit Website content for a competing service without permission; or
- use the Website in a way that violates law or another person’s rights.
We may restrict use that we reasonably believe is abusive, unlawful, fraudulent or harmful.
9. Intellectual property
The Website and its original text, design, layout, graphics, code, branding and other content are owned by or licensed to ROOFNOW and protected by applicable law. ROOFNOW™, associated slogans, logos and brand elements may not be used in a way that suggests endorsement or affiliation without written permission.
Product names, logos, photographs and trademarks belonging to manufacturers or other parties remain their owners’ property. Limited viewing or printing for personal project evaluation is permitted; no other rights are granted.
10. Information and materials you submit
You remain responsible for submitted information and confirm that you have the right to provide it. Do not submit confidential third-party information, unlawful content or materials that infringe another person’s rights.
You authorize ROOFNOW and its service providers to use submitted messages, addresses, measurements, documents and project photographs as reasonably necessary to respond, assess the roof, prepare an estimate and provide requested service. Identifiable project materials will not be used in public marketing without any permission required by law or agreement.
11. Third-party websites and services
The Website may link to manufacturers, suppliers, financing providers, social platforms, educational resources, maps, form processors and other third parties. Their services are governed by their own terms and privacy practices.
A link does not mean ROOFNOW controls, guarantees or accepts responsibility for the third party’s content, availability, security, conduct or services.
12. Website availability and changes
We may update, correct, suspend, restrict or discontinue any part of the Website. We do not guarantee uninterrupted, error-free or secure access. Content may become outdated, and typographical, technical or image errors may occur.
Website changes do not alter an accepted roofing contract unless that contract is properly amended.
13. Website disclaimers
To the fullest extent permitted by law, the Website and general content are provided “as is” and “as available,” without representations or warranties that the Website will be uninterrupted, error-free, complete, current or suitable for a particular property or purpose.
Nothing here disclaims an express written warranty issued for a project or a condition, warranty, remedy or consumer right that law does not permit us to exclude.
14. Limitation of liability
To the fullest extent permitted by law, ROOFNOW and its directors, employees and representatives will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages arising solely from Website use, inability to use it, reliance on general content or third-party links.
Where liability cannot be excluded, any limitation applies only to the maximum extent permitted by law. This does not limit remedies under an accepted roofing contract except as that contract and applicable law expressly provide.
15. Responsibility for misuse
To the extent permitted by law, you are responsible for reasonable losses, claims and expenses arising from your unlawful misuse of the Website, intentional violation of these Terms, infringement of another person’s rights or fraudulent information you submit. This section does not apply where consumer law prohibits it.
16. Privacy and communications
Our handling of personal information is described in the ROOFNOW Privacy Policy. By asking us to contact you, you authorize project-related calls, emails or messages reasonably necessary to respond. Marketing communications remain subject to applicable consent and unsubscribe requirements.
17. Governing law and Ontario consumer rights
These Website Terms are governed by Ontario law and the federal laws of Canada applicable in Ontario. Subject to a mandatory consumer forum or other non-waivable right, disputes concerning these Website Terms will be brought before courts with jurisdiction in Ontario.
Nothing in these Terms excludes, restricts or waives a right or remedy that cannot lawfully be excluded under the Ontario Consumer Protection Act, 2002 or other applicable law. Ontario also provides consumer information about home renovations and repairs.
18. General terms
Severability
If a provision is invalid or unenforceable, it will be limited only to the extent necessary, and the remaining provisions will continue.
No waiver
A failure to enforce a provision is not a waiver of it or another right.
Assignment
You may not assign rights under these Website Terms without written consent. ROOFNOW may assign them as part of a corporate reorganization, financing, sale or transfer of the Website or business, subject to law.
Relationship to project documents
These are the complete terms for Website use. They are not the complete agreement for roofing work; accepted project documents govern that work.
19. Changes to these Terms
We may update these Terms when the Website, services or legal requirements change. Revised Terms will be posted with a new effective date. Changes apply prospectively to Website use and do not rewrite an existing roofing contract.
